On Friday, April 26, the Supreme Court denied requests for a Voter Verifiable Paper Audit Trail (VVPAT) and 100% cross-verification of votes cast using electronic voting machines. The court further revealed that “blindly distrusting” any part of the system can lead to unjustified scepticism.
Two unanimous rulings were rendered by a bench of Justices Sanjiv Khanna and Dipankar Datta, dismissing all of the pleas in the case, including those requesting a return to ballots used in previous elections.

The ballot unit, control unit, and VVPAT are the three components that make up an EVM. Microcontrollers with factory-burned memory are incorporated in all three. Presently, each assembly constituency has five booths using VVPATs.
After symbols are loaded onto electronic voting machines, Justice Khanna ordered the Election Commission of India to store and seal the units used to load the symbols for a period of forty-five days.
At the request of the runners-up and third-place contenders, the Supreme Court further permitted the engineers of the EVM manufacturers to confirm the microcontroller of the machines following the announcement of the results. The highest court ruled that, upon payment of fees, a request for the microcontroller’s verification may be made within seven days of the results being announced.
Meanwhile, the Delhi High Court on Friday adjourned the hearing in a petition seeking a six-year ban on Prime Minister (PM) Narendra Modi from contesting elections, for violating the model code of conduct (MCC) by seeking votes in the name of religion. Justice Sachin Datta adjourned the plea since he was heading a tribunal under the Unlawful Activities Prevention Act (UAPA) and the case will now be heard on April 29, Monday.
50-year-old Justice Sachin Datta was born in 1973 on 15 August in Delhi. In 1991, he completed his schooling in Delhi from Delhi Public School, RK Puram. In 1994, he graduated from St Stephen’s College, Delhi. He then attended the Campus Law Centre and graduated in Law in 1997. Sachin Datta then enrolled himself with Delhi Bar Council.
Justice Sachin Datta has a career spanning decades and he has worked on a variety of cases. In Supreme Court and Delhi High Court, he has served as a representative for a number of public sector undertakings. He has also served as a counsel in numerous International Arbitration matters.
He represented the Central Government in the Supreme Court and before many tribunals. In 2014, the Delhi High Court gave him the designation of a senior advocate.
