Wearing, reportedly homeless and residing within the train system, engaged in a physical altercation with an unidentified man on the platform.
Victim Fell Onto Train Tracks
The dispute, captured on video obtained by law enforcement, escalated into violence, with Wearing striking the other man aged 38 twice. Tragically, the victim fell onto the train tracks just as an incoming SEPTA train approached, resulting in immediate fatality.
The 34th Street Station experienced a temporary shutdown for several hours, affecting SEPTA service between 30th and 40th streets. Video evidence and eyewitness accounts formed the basis for Wearing’s involuntary manslaughter charge.
In addition to this charge, 40 year old Wearing is currently under bench warrant status for an unrelated strangulation case in Delaware County, with a criminal history spanning Clinton and Lycoming counties.
Law enforcement apprehended Wearing at the 40th Street Station after the altercation. SEPTA officials implemented bus reroutes for riders between 30th and 40th streets during the investigative process.
Concerns regarding violence within the transit system have been voiced by riders, citing a noticeable increase in incidents over the years. The District Attorney’s Office highlighted that charges against Wearing may be subject to change pending further information.
The victim’s identity remains undisclosed, and authorities are urging individuals with relevant information to come forward. As the investigation unfolds, additional details about the case are expected to be disclosed by authorities.

Police reported that a 38-year-old man maintained a grip on Wearing who is a homeless man and lived in the station while admonishing him and making threatening gestures. Subsequently, Wearing managed to break free and delivered two punches to the man.
In the ensuing scuffle, Wearing tumbled onto the platform, while the 38-year-old man fell onto the tracks below, ultimately succumbing to an oncoming SEPTA train.
Philadelphia Police Inspector Kpana Massaquoi informed the media, “There appeared to be some type of physical altercation. We don’t know exactly what took place prior to that to initiate this, but it’s being investigated at this point.”
Wearing was apprehended at the 40th Street Station during the next stop, according to police. The 34th Street Station remained closed for several hours on Thursday afternoon, along with the surrounding area near Drexel’s campus.
