Geico, the vehicle insurance giant, has been ordered to pay a Missouri woman $5.2 million after she claimed to have contracted a sexually transmitted disease while having sex in a car with her ex-boyfriend. According to the woman, her ex-partner was covered by Geico, and she was entitled to reimbursement because she caught STD while having sexual intercourse with him in the automobile.

Woman Contracted STD and Claimed $5.4 Claim Settlement against Geico

A Missouri woman was given a $5.2 million payout from her ex-partner’s car insurance company after claiming she had a sexually transmitted disease while having sex with him in his vehicle. According to the Kansas City Star, the state Court of Appeals on Tuesday upheld a multimillion-dollar arbitration award against Geico after the company claimed mistakes were made in Jackson County Circuit Court.

Geico has opted to take the case to federal court, claiming that the claim is not covered by the policy. After allegedly contracting HPV, the human papillomavirus, from her then-beau in his automobile, the woman identified in court filings as M.O. told Geico of her plan to claim damages in February 2021.

Geico had to pay $5.4 Million as Company’s Appeal in Court was Rejected

When the woman’s ex-boyfriend was aware of his condition and the dangers of unprotected intercourse, she claimed he caused her to contract the STD. The couple’s intercourse in the vehicle directly caused, or directly helped to create the HPV infection, according to an arbitrator. According to the news site, the woman was granted $5.2 million by Geico after the male was deemed accountable for failing to disclose his infection.

The insurer requested that the award be vacated, saying that the verdict infringed on its right to due process, but it’s request was denied. The three-judge panel decided on Tuesday that the lower court did not err in refusing Geico’s requests, stating that the company did not have the right to re-argue the issues.

Geico was given no real opportunity to join in the action, according to one of the judges, and existing legislation relegates the insurer to the status of a bystander.
