Rapper Takeoff was shot dead just as he was ready to go on trial for an alleged rape at a Los Angeles house party. The Migos producer DJ Durel’s residence is where the 28-year-old is accused of sexually assaulting a lady in June 2020. On November 1, Takeoff was tragically murdered at a home gathering in Huston, Texas.

What did the victim file?
The victim filed a civil complaint in August against Takeoff, real name Kirshnik Khari Ball, but no legal action was ever taken. The judge set the late rapper’s testimony for January, and then set a jury trial for next June. A revolver was allegedly visible on a table when the plaintiff, Jane Doe, who identified herself as the victim, claimed to have been at the Encino party at 7 p.m. while Takeoff arrived sometime later.
According to court filings, she claimed that before telling Durel, real name Daryl McPherson, that she had no interest in having an intimate relationship with the rapper, Takeoff tried to sell her marijuana and his staring made her feel uncomfortable. According to the court papers, Takeoff and Jane Doe ran into each other as they ascended the stairs, and as The Sun reported, a fight ensued.
The complaint claims that Defendant Takeoff started groping Plaintiff’s buttocks. Defendant Takeoff’s advances were politely declined by Plaintiff, who made it obvious that she didn’t want to have sex with him. Despite the plaintiff’s specific request, the defendant seized the plaintiff, turned her over face-down, and pulled her clothes down. After that, Defendant Takeoff engaged in forcible sexual contact with Plaintiff from behind without her permission. Defendant Takeoff exited the room right away after raping Plaintiff.
The Los Angeles Police has taken the case.
On the same day that the plaintiff sought medical attention, hospital employees in the area saw physical signs of forced rape and reported them to the Los Angeles Police Department. Despite police involvement in April of last year, the LA District Attorney’s office decided not to charge Takeoff with a felony due to a lack of evidence. In his answers, Takeoff angrily denied each and every charge, claiming that the damages and injuries, if any, incurred by Plaintiff were directly and proximately caused only by the irresponsible, reckless, negligent, and wrongful behaviour of individuals or entities other than Defendant.
The case has been pending at Los Angeles Superior Court.
The case dragged on in the Los Angeles Superior Court for more than two years due to ongoing legal issues between the counsel for the parties over whether Takeoff should testify in person or through video from his home in Georgia.
The plaintiff’s attorney finally filed an application for an order requiring Takeoff to appear and testify at a deposition on January 17, 2023, at 8:30 am, and to pay $2,860 in legal fees after much back and forth. It states as follows: “Despite many meet and confer attempts between the parties regarding alternate dates, Defendant has failed to show for his properly noticed deposition. Defendant’s delay has compelled Plaintiff to bring this move after a year of meet-and-confer efforts.”
