Vadim Shishimarin, a 21-year-old Russian soldier, was sentenced to life in jail for killing a civilian by a Ukrainian court on Monday in the first war crimes trial stemming from Russia’s invasion. There is no information on his family at the moment.
He belongs to the prestigious 4th Guards Tank Division and killed an unarmed 62-year-old citizen in Sumy on February 28 who died on the spot, only a few hundred meters from his home.
The Criminal Order Charges
Shishimarin stated that he shot civilian Oleksandr Shelipov through an open car window on instructions from two policemen who claimed Shelipov, who was conversing on his telephone, might pinpoint their location to Ukrainian forces.
Shishimarin was following out a “criminal order,” according to Judge Serhiy Agafonov “A higher-ranking soldier had fired three rounds at the victim’s head with an automatic weapon. “Given that the act committed is a crime against peace, security, humanity, and the international legal order… the court does not see the prospect of imposing a (shorter) term,” the court stated.
Viktor Ovsyannikov, Shishmarin’s lawyer, said he was not shocked by the sentence since there had been “some societal pressure,” and that he would file a legal appeal. Ovsyanikov had previously claimed that his client was preparing for the “violent military battle” and large casualties that Russian forces experienced during their initial invasion of Ukraine.
Shishimarin urged the victim’s widow, who also testified in the trial, to forgive him for what he did on Thursday. Kateryna Shelipova, the wife, stated that she discovered her husband dead just outside their home after the pair heard gunshots and he went to investigate.
Shishimarin was charged under a part of the Ukrainian penal code dealing with war rules and customs. As Ukraine’s first war crimes trial, his case was carefully followed. The trial, which began only a few weeks ago, has taken on a symbolic significance for Ukraine. According to Reuters, this might be the first of many.
Crimes in the Russian War
As the world has urged for Russia to be held responsible for its invasion, Ukrainian prosecutors are probing hundreds of suspected war crimes. Russian soldiers destroyed a theatre where people were taking refuge, as well as a maternity facility. Following Moscow’s pullout from cities around Kyiv a few weeks ago, mass graves and streets littered with victims were uncovered in villages such as Bucha.
