A letter dated February 10 from the University Student Disciplinary Committee (“USDC”) announced the suspension of Mukundan M Nair who is a BBA LLB student for the entirety of this year’s Spring Semester.

Reportedly Nair played a prominent role in organizing the contentious event titled “Ram Mandir: A Farcical Project of Brahmanical Hindutva Fascism,” which took place on February 7 and generated significant controversy.

The correspondence Indicated, “You are hereby suspended for the remainder of the Spring 2024 semester.” The members of the USDC reached a unanimous decision to suspend the student, citing not only a breach of the Code of Conduct but also a violation of the country’s laws.
While the University showed leniency by acknowledging it as the first violation, it specified that the student’s return to the campus would be contingent upon the prevailing situation on the University campus, the student’s conduct during the suspension, and the fulfillment of other specified conditions as determined by the Committee.
The Committee determined that the student’s actions likely infringed upon the laws of the land. It emphasized, “For instance, the derogatory and provocative statements made in the poster, along with the event advertised, may lead to legal repercussions under Sections 153A, 295A, 298, and 505, in conjunction with Section 120B, of the Indian Penal Code, 1860.”
The alleged letter additionally stated, “Finally, your intentional remarks aimed at provoking discontent towards the ‘Ram Mandir’ institution and ridiculing the ‘Pran Prathishtha’ ceremony may be deemed as contempt of the Supreme Court of India.

“Advocating for the destruction of all temples, including the Ram Mandir, directly contradicts the decision of the Supreme Court of India, potentially constituting contempt of court.”
The USDC determined that the mentioned student did, in fact, breach the Student Code of Conduct and engaged in acts of indiscipline under Clause 28 of Section 5 of the O.P. Jindal Global University Code of Conduct for students (“Code of Conduct”).
Disciplinary Measures Initiated
The disciplinary measures were initiated by the Chief Proctor’s Office (“CPO”) following their independent observation of an incident near the ‘Hangout’ area on February 7, 2024.
The allegations included the placement of posters and involvement in conversations containing highly derogatory and provocative language, with the apparent intention of negatively impacting the integrity and tranquility of the university space.

A Show-Cause Notice (“SCN”) was dispatched by the CPO on February 9, 2024. In response, dated February 10, the student refuted all allegations.
Despite being granted the opportunity for a defense, the student failed to appear before the USDC, consisting of faculty and staff members, along with representation from the JGU Student Council.
The student, In written arguments, asserted the exercise of the right to free speech in a democratic setup and claimed no affiliation with any student organization aligning with a specific political ideology.
However, the USDC, in its findings, determined that the student, in collaboration with three others, had displayed problematic posters across the Academic Block, containing statements capable of offending the religious sentiments of a specific JGU Community section.
The committee highlighted the absence of official permission for the event advertised in the poster and the lack of administrative vetting before public display on the campus.
Consequently, the USDC unanimously decided to suspend the student.
