A sitting judge on the Allahabad High Court, Justice Shekhar Kumar Yadav, has once again stirred controversy with his remarks that India will only follow the preferences of the people belonging to the majority community, Hindus.

That being said, Justice Yadav’s inflammatory comments have made headlines before. He has also been known to make decisions in the past that have religious and ideological connotations, such as defending cows, Ram, or religious conversion.

Videos of the high court judge discussing controversial topics, such as the rule of law operating according to the majority, went viral a day after he spoke at a provincial convention of the Vishva Hindu Parishad’s (VHP) legal cell and high court unit. Several opposition parties responded strongly to this, questioning his reported remarks and denouncing them as hate speech.

60-year-old Justice Shekhar Kumar Yadav was born on April 16, 1964, and attended Allahabad University to obtain his legal education. He earned his degree in 1988. In 1990, he became an attorney and started practicing law in the Allahabad High Court, specializing in civil and constitutional law.

He took oath as an Additional Judge on Dec 12, 2019 and took oath as Permanent Judge on Mar 26, 2021. His retirement is due in April 2026.

Justice Shekhar Kumar Yadav career

Before assuming the duties of Additional Chief Standing Counsel, Justice Shekhar Kumar Yadav served as the State of Uttar Pradesh’s Additional Government Advocate and Standing Counsel. In addition, he represented VBS Purvanchal University, Jaunpur as its Standing Counsel and was a Senior Panel Counsel for the Union of India and the Railways.

Justice Yadav joined the Allahabad High Court as an extra judge on December 12, 2019. On March 26, 2021, he was confirmed as a permanent judge.

In addition to comments made outside of court, Justice Yadav has included ideological overtones in some of his rulings.

He called on the Central government to enact legislation in October 2021 that would honor the Ramayana, the Mahabharata, the Bhagavad Gita, Lord Ram, Lord Krishna, and other texts. In that instance, he cited the Supreme Court’s ruling in the Ram Janmabhoomi case when granted bail, stating that it favoured “Ram” believers.

He stated in September 2021 that the government ought to pass legislation bringing cows within Part III of the Constitution’s list of fundamental rights and adopt stringent measures to punish individuals who advocate for the harm of cows.
