There has been a lot of outrage and calls for the Supreme Court to step in after an Allahabad High Court judge Ram Manohar Narayan Mishra’s recently stated that a man’s alleged actions of grabbing an 11-year-old girl’s br*asts, breaking her pyjama strings, and dragging her under a culvert are insufficient grounds for charging him with “attempt to r*pe.”

Senior attorney Indira Jaising demanded that the Supreme Court take up the case on its own initiative. “SC has pulled up judges for much less,” she stated.

60-year-old Justice Ram Manohar Mishra was born on November 6, 1964. He earned his law degree in 1985 and pursued post-graduation legal studies in 1987. While he belongs to a Brahmin Hindu family, the details of his family members aren’t known.

In 1990, Justice Ram Manohar Mishra became a Munsif in the Uttar Pradesh Judicial Service. He received a promotion to the Higher Judicial Service in 2005. He was named a District and Sessions Judge in 2019. He was the District and Sessions Judge in Lucknow and the Director of JTRI before being promoted.

In June 2023, the Kasganj POCSO court, acting on an application filed by the mother of a girl, had issued summons to two youths, who are cousins, to face trial on charges of r*pe and r*pe attempt and the court had also summoned the father of one of the youths who was charged with criminal intimidation. In January 2022, a woman had filed an application in the Kasganj POCSO court seeking direction to the police to register an FIR against three men for r*pe.

The Allahabad High Court’s Justice Ram Manohar Narayan Mishra has now directed the POCSO court to change the definition of r*pe to “assaulting or abusing with an intent to disrobe or compel her to be n*ked.”

In his order, Justice Mishra of the High Court said: “After giving a thoughtful consideration and meticulous examination of the facts of the case, this court is of the considered opinion that mere fact that according to prosecution version the accused… grabbed the bre*sts of the victim and one of them broke the strings of her pyjamas and tried to drag her beneath the culvert. In the meanwhile, on interference of passersby/witnesses the accused persons fled away from the spot leaving the victim behind, is not sufficient to hold that a case of section 376 (punishment for r*pe), 511 IPC (attempt to an offence) or section 376 IPC read with section 18 of the POCSO Act has been made out against the accused persons.”

“This court finds that the finding of the learned court below with regard to the offence of attempt to r*pe… in the impugned summoning order is not sustainable, and instead they are liable to be summoned for minor offence under sections 354(b) IPC read with section 9/10 [aggravated s*xual assault] of POCSO Act. The impugned summoning order stands modified accordingly,” Justice Mishra ordered.

The High Court’s single bench ordered the trial court in Kasganj district to send new summonses to the two accused who were arrested for r*pe on the amended charges in an order dated March 17.

The accused filed a petition in the High Court contesting the summons to stand trial in a r*pe case that the Special Judge of the POCSO court in Kasganj had sent them.

Section 354-B, which falls within the category of serious s*xual offenses, will be used to punish according to Justice Ram Manohar Mishra rather than Section 376. The court further stated that it is critical to distinguish between preparation for the crime and attempted r*pe.
