Despite earlier objections from the Center due to his outspoken opinions on social media, lawyer Somasekhar Sundaresan was officially appointed as an Additional Judge of the Bombay High Court, according to a recent notice from the Law Ministry.

In exercise of the power conferred by the Constitution of India, the Hon’ble President of India, after consultation with Hon’ble Chief Justice of India, is pleased to appoint Shri Somasekhar Sundaresan, Advocate, as an Additional Judge of the Bombay High Court.

In February of the previous year, the Supreme Court Collegium had initially supported Somasekhar Sundaresan’s nomination for a judgeship at the Bombay High Court.

Nonetheless, the government requested that the Collegium reevaluate its decision in November 2022. The Center found Sundaresan a “highly opinionated person” who was “selectively critical on social media of the important policies, initiatives, and directions of the government”.

However, reiterating their recommendation for Sundaresan’s elevation, the Collegium remained steadfast and informed the government that there was “no material to indicate that the expressions used by the candidate [Sundaresan] are suggestive of his links with any political party with strong ideological leanings.” The Collegium had reasoned that anything he had stated on social media was already a matter of public discussion.

Who is Somasekhar Sundaresan?

Somasekhar Sundaresan is a renowned Indian judge. He has been in the news because he was recently appointed as an Additional Judge of the Bombay High Court after several months of delay.

A 1996-batch graduate in law from Government Law College, Mumbai, 50 year old Sundaresan worked as a journalist for over five years before taking up law.

After beginning his career as a journalist, Somsekhar Surendran moved into a position where he made a substantial contribution to a number of committees that were set up by the Ministry of Corporate Affairs, the Securities and Exchange Board of India (Sebi), and the Union government. His main responsibility was to assess the nation’s legal and regulatory systems and provide recommendations for changes.

Somasekhar Sundaresan entered the legal domain as a lawyer and quickly established himself as a specialist in regulatory and compliance issues. He concentrated mostly on areas like corporate governance, mergers and acquisitions, and securities legislation. One of his primary areas of legal competence is negotiating the complex regulatory compliance environment that exists in these industries.

Soon, he became a judge and headed several important cases. Notably, he was a member of the expert panel constituted by the Supreme Court that just released its findings in the Adani-Hindenburg case.
