Who are the accusers?

The three defendants were named as Saksham Patel (20), who completed his studies up to class 10; Kunal Pandey (28), who completed his studies up to a B.Com. and operated a shop; and Abhishek Chauhan (22), who worked at a saree shop after failing his class 10 exam. Each of the three calls Varanasi home.

In their social media accounts, two of the three accused stated they were connected to the Varanasi-based IT unit of the BJP. Saksham Patel identified himself as a co-coordinator for the Varanasi unit of the BJP IT cell, while Kunal Pandey claimed to be a coordinator. However, they do not belong to the new group that was assembled following Diwali. Bhupendra Chaudhary, the head of the UP BJP, refused to comment on the matter. Chief of the state BJP IT cell Kameshwar Nath Mishra remained silent when asked if the accused had any connection to the Varanasi IT cell of the party.

The defendants have been sent to judicial detention

As per the police, the trio was taken into custody on Saturday evening, and they have admitted to the offence. Ram Sevak Gautam, the DCP for the Kanchi zone in Varanasi, told reporters on Sunday that they had recovered mobile phones from the accused as well as the motorcycle they used in the crime. The three accused were placed in judicial detention for 14 days by a local court on Sunday night.

DCP Gautam was asked if the suspects had any connection to the BJP IT cell, to which he responded that it made no difference who someone was related to. They would also make use of the Gangsters Act in addition to investigating their possible criminal past.

What did the victim state in the FIR?

The resident of the IIT-BHU hostel said in her police complaint that when she went for a walk on November 2, leaving her hostel at roughly 1:30 am, she met with a male buddy. As they strolled beside each other, a motorcycle with three males pulled up behind them, due to which she and her companion were split apart.

Later, they took me to a corner, sealed her mouth shut, kissed her violently, undressed her, and took pictures and videos of her. They threatened to kill her when she yelled for assistance. After ten to fifteen minutes, they let me go. After that, she took refuge in a professor’s house, and he led me to the security personnel, as the woman remarked.

Which accusations have been lodged against the defaulters?

Under IPC sections 354-B (assault or use of criminal force against a woman with intent to disrobe) and 506 (criminal intimidation), as well as the IT Act, an initial formal complaint was filed against two unidentified individuals.

A few days following the event, the victim provided a follow-up statement, which led the police to add gangrape charges to the FIR. There were additional additions to IPC Sections 341 (wrongful restraint), 342 (wrongful imprisonment), 507 (criminal intimidation by anonymous communication), and 509 (word, gesture, or act intended to insult a woman’s modesty).

According to sources, the Proctor’s office was notified two days before the occurrence that another student had experienced a similar situation on the evening of October 30. The institute’s dean revealed that the Proctor’s office had received a complaint about the events of October 30 and that appropriate action was being taken.
