On Wednesday, US Vice President Joe Biden dubbed Russian President Vladimir Putin a “war criminal” for the ongoing invasion in Ukraine, which has resulted in the bombing of hospitals and maternity facilities.
However, labelling someone a war criminal is more complicated than just speaking the words. For identifying who is a war criminal and how they’re being punished, there are established definitions and procedures.
The White House had been debating whether or not to apply the label to Putin, claiming that it would necessitate an investigation and an international decision.
Jen Psaki, the White House press secretary, claimed Biden was “speaking from his heart” when he used the word and asserted that a formal judgement is made through a procedure.
The probes into Putin’s activities, on the other hand, have already begun. Following the ratification of a resolution by the United Nations Human Rights Council to form a commission of investigation, the United States and 44 other nations are cooperating to examine suspected breaches and abuses.
The International Criminal Court, an independent agency located in the Netherlands, is conducting another investigation.
What Is A War Criminal Meaning Explained And Punishment Given
The word refers to someone who breaks the law of armed conflict, which is a set of regulations approved by international leaders. In times of conflict, the norms regulate how countries behave.
Those laws have been updated and enlarged during the last century, based on the Geneva Conventions and protocols established later in the aftermath of World War II.
The laws are intended to safeguard persons who are not fighting or who are unable to fight, such as civilians such as physicians and nurses, injured troops, and prisoners of war.
Treaties and agreements define who can be targeted and how they can be targeted. Certain weapons, such as chemical or biological agents, are outlawed.
However, in common usage, the word “war criminal” has acquired a colloquial connotation as a general term for someone who is terrible.
Today, most war crimes are now punishable in two ways: death or long term imprisonment and in order to be given one of these sentences, any instance of a war crime must be taken to the International Criminal Court (ICC). The ICC was founded on July 1, 2002 for the purpose of bringing war criminals to trial and the power of the court is based on a treaty and 108 separate countries support it.
What Specific Crimes Make Someone A War Criminal & Why Biden Called Putin A War Criminal?
Willful killing, massive devastation, and expropriation of property not justified by military necessity are examples of so-called “grave violations” of the treaties that amount to war crimes.
Other war crimes include the purposeful targeting of people, the use of excessive force, the use of human shields, and the kidnapping of civilians.
Crimes against humanity are also prosecuted by the International Criminal Court when they are committed in the context of a “widespread or systematic attack intended against any civilian population.” Murder, annihilation, forceful transfer, torture, rape, and sexual enslavement are among them.
Putin is most likely to be implicated as a war criminal as a result of the generally accepted legal notion of command responsibility. Commanders can be held legally liable if they issue orders, know about crimes, or are in a position to know about them and do nothing to prevent them.
