Both the doctors were charged under section 304 of the IPC. This section states that culpable homicide does not amount to murder and IPC section 18 for the Transplantation of Human Organs Act, 1994.
Moreover to this failure, it was also further found that the Dr. Dhani Ram Heart Institute and Research Centre has not taken nor obtained or applied registration as it was required under the transplant law. But now Dr. Dhani Ram Barua is quite happy when the same experiment took place in Maryland. His associate has announced the same in the media.
