He was put on life support by medical personnel, but that didn’t speed up his recuperation. After an MRI scan in May revealed that the youngster was brain dead, the court authorised the “withdrawal of Archie’s life support.”

Who Was Archie Battersbee?

Archie Battersbee was just a normal boy who has recently been in the news because he died recently in an unfortunate series of events which involves the infamous social media challenge named “Blackout Challenge.”

He was born on 10 March 2010 in Southend, Essex, England. His mother’s name is his mother, Hollie Dance and his mother’s name is Paul Battersbee.

He was pronounced on 6 August 2022 at 12:15 BST. At the time of his death, he was just 12 years old.

His Death Cause

He had a ligature over his head when his mother, Hollie Dance, discovered him unresponsive. After giving CPR, she made an ambulance call. Later, she claimed that she thought he was participating in the risky “blackout challenge,” a TikTok dare that is performed online, even though there is no proof of this.

He had a cardiac arrest and had no pulse when he arrived at Southend University Hospital. Around 40 minutes after his mother had discovered him unconscious, he started to reestablish spontaneous circulation.

Due to a prolonged shortage of oxygen and blood flow to the brain, it is thought that Battersbee suffered brain damage during this cardiac arrest. The Royal London Hospital received him the next day after his relocation. He was pronounced brain dead there and after his life support system was removed, he died.

How Archie Battersbee’s Death Has Caused Legal Controversy?

In response to Battersbee’s parents’ refusal to allow the hospital to conduct brainstem testing on him, a legal battle between them and the Barts Health NHS Trust and a guardian chosen by the Children and Family Court Advisory and Support Service for Battersbee was launched at the High Court on April 26.

The Court of Appeal and the Supreme Court heard further appeals.

The Trust contended that Battersbee’s medical care should end because he was brain dead and had no chance of recovering. However, Battersbee’s parents claimed that he required more time to recover and that his religious convictions should be taken into consideration.

His family also made an attempt to have the European Court of Human Rights heard the case, but it was rejected because it lacked jurisdiction and the United Nations Commission for The Rights of People with Disabilities had no jurisdiction.

The courts, again and again, adjudicated that child’s treatment should stop, stating that the Children Act 1989 necessitates decisions to be made with the child’s welfare foremost at all times. So, all challenges by the family members against the courts’ rulings – excluding one legal point; that Battersbee wasn’t already legally dead – were rejected.

On August 6, 2022, his life-supporting devices, including mechanical breathing, were eventually removed, and Battersbee was declared dead.
