On June 13, the Bombay High Court ordered Maharashtra’s Chief Public Prosecutor (PP), Aruna Pai, to seek directions from the State Home Ministry and file a no-objection statement regarding the release of Nikhil Bhamare, a 22-year-old final year pharmacy student from Nashik. For alleged insulting social media statements on Nationalist Congress Party (NCP) head Sharad Pawar, at least six First Investigation Reports (FIRs) have been filed against Bhamare.
Nikhil who comes from a farmer’s family is originally from Dindori in Madhya Pradesh and was staying in Nashik in a rented accomodation from where he was arrested. His arrest follows a trend which has become too commonplace since the MVA government has come into power with scores of people being arrested from social media posts which fail to resonate with people in power in the state currently.
Bhamare had sent a tweet in May that sparked a flurry of complaints, and he was imprisoned and forced to skip his examinations as a result.
Sections 153, 153A (Promoting enmity between communities), 500, 501 (defamation), 504 (criminal intimidation), 505, and 506 (statements contributing to public mischief) of the Indian Penal Code were used to charge Bhamare (IPC).
On Monday, a two-judge bench comprised of Justice SS Shinde and Justice MN Jadhav heard Bhamare’s lawyer Subhash Jha’s petition for the quashing of FIRs. As a stopgap solution, Bhamare requested his release from detention.
During the hearing, Justice Shinde pointed out that the FIR did not contain Bhamare’s name, despite the fact that he has been in custody for almost a month. He noted, “Nobody is listed on page 48 (which included Bhamre’s main tweet) and to imprison someone for a month.” What gives you the impression that this is the foundation of all things? “As mentioned on page 48, what precipitated the FIR?”
Advocate Jha stated in his argument that the initial FIR against Bhamare was filed at the Naupada Police Station in Thane. “Some student is kept in captivity like way,” Justice Shinde said. Even the most powerful personality will despise the fact that such a student is detained.” When Arnab Goswami, the Republic’s editor-in-chief, was arrested by Mumbai police over a reopened case, he was denied bail by Justice Shinde.
Apart from Bhamare, Marathi actor Ketaki Chitale was also detained and charged with making insulting statements against Pawar on social media. She has been incarcerated for almost a month.
On June 16, the matter will be heard again.
